Firing back at critics who contend that its advertising software uses illegal
delivery tactics, Gator.com said Tuesday it has filed a lawsuit against one of its most
vociferous detractors, the Interactive Advertising Bureau (IAB), asking a U.S.
court to declare that the trade group's charges are "unfounded."


The IAB has argued that Gator's updated software essentially poaches advertising on other
sites, by subverting those paid-for online ads with alternative ads of Gator's own
choosing.

I think this is an interesting case. Of course, it's hard to have any sympathy for Gator.com - just the word "pop-up" makes my skin crawl. But I don't think judges care about that.

I think the online ad controversy -- and to some extent, the spam controversy -- will be shaped by the adoption of broadband. The faster this stuff arrives and the easier it is to delete, the less users will be annoyed by it, I think.
